What happens when Enbridge Gas NB’s provincial contract expires?

Despite challenges Enbridge Gas NB may have had with the energy policy and regulations, it’s been a very positive experience over our 14+ years in the province. And we’ve always expressed the desire to continue operating the public distribution system past the contract period, as long as the business conditions allow us to. Our employees in different roles and all walks of life are eager to continue serving New Brunswickers by delivering safe, reliable, and affordable natural gas through the public distribution system in NB well into the future.

The New Brunswick government has imposed conditions that are unlike those faced by public gas utilities in any other North American jurisdiction. This environment makes it very difficult, if not impossible, for us to attract more investment to New Brunswick and grow our customer base. Enbridge Gas NB is pushing for a reformed system that benefits all customers so we can deliver natural gas and reduce costs for all customers for the long term.

Why are you suing the government?

There are two separate lawsuits. The first is specific to the Government of NB’s breach of the General Franchise Agreement signed in 1999. The second is because the government made changes which took away Enbridge Gas NB’s deferral account, a critical mechanism commonly used in all utilities across North America to help provide low and stable rates to customers.

Generally, legal action is not a step anyone wants to take and we’re constantly looking for pro-active solutions but it was necessary because the government of New Brunswick broke our contract. We signed this in 1999 and it established Enbridge Gas NB as the public utility responsible for building and maintaining the provincial natural gas public distribution system. While suing the government might not look good in the public’s eyes, it’s necessary to stand up for our rights and protect our customers, employees, and our business against unfair government action.
